Key Things to Think About If You’re Interested in a Prenup

Marriage is an entirely new journey for you and your partner. You’re headed towards a new and bright future, one in which you do many things together like build a family, establish a home to call your own, and weather a new sets of ups and downs together as a family unit. It’s important to remember, however, that marriage isn’t always sunshine and rainbows. At the end of the day, there are still parts of marriage where we must make decisions with our heads rather than our hearts. This is where a prenup or a premarital agreement can enter the picture.

While the concept of a prenuptial agreement can be similar across countries, some nations and cultures have slight differences on the subject. In India, prenups aren’t binding under existing marriage laws because, culturally speaking, marriage is more a religious bond than a contract. As a result, there’s no particular law that actually talks of the enforceability or legality of prenups in the country yet. While prenups aren’t extremely widespread across the nation, they are considered as contracts and are therefore under the jurisdiction of the Indian Contract Act.

Below are some key things to think about if you’re looking to get a prenup, since these kinds of agreements are not the simplest things to understand. Settling on an actual written agreement in order to form a compromise on delicate money matters and more is not a very comfortable conversation for any couple to have. However, if you are considering a prenup, the key things below might be worth looking at.

What Does a Prenup Cover?

No two premarital agreements are the same, which means it’s extremely important to understand what is covered and what is not included in a premarital agreement. In a general sense, valid premarital agreements tend to provide answers to some pressing matters involving the obligations and rights of the couple towards assets each individual has obtained before and during the marriage.

  • Parts of these assets include income, real property, earnings, and more. Prenups can actually dictate who gets to use, buy, transfer, sell, lease, or even dispose assets upon certain situations. These situations also include events where one of the partners or the couple has been separated, disinherited, or has died.
  • Likewise, a valid agreement can preserve the property the couple has brought with them into the marriage, and distribute the rights of the couple on these properties and income acquired from them throughout the marriage. In fact, a prenup can provide the means to allocate a specific sum of resources to either spouse should they be separated.
  • Should both parties wish to be extra precise with the terms of what they do during the marriage, especially with legal concerns, lawyers well-versed in prenups may allow them to do so. For instance, take the intricacies of auto accidents. Both parties may be allowed to decide on the course of action should one of them be involved in an auto accident and happens to be in a condition where they cannot decide anything for themselves.
  • According to The Quint, although prenups aren’t “legal” in the strictest sense of the word in India, for example, partners who wish to have an agreement are still free to form a “contract” that acts similarly to a prenup and has guidelines for them to follow in case something happens to their marriage. This means they aren’t to be underestimated or devalued in India, as the merits of these contracts are still seen in use often and often applied to marriages. 

What’s Not Covered in a Prenup?

Prenups are also helpful in making sure there aren’t any rights or obligations that are mishandled during the marriage. This means both parties get an equal say on how they want certain aspects of the prenup to be managed, and it’s better to have lawyers clarify these specific situations so everyone has a common understanding.

For instance, both parties should be careful that the agreement they create doesn’t promote the marriage dissolution. Courts have the right to refuse the enforcement of a prenup if there are incentives for both parties to divorce. This is an important factor, as a prenup only accounts for the realistic and rational attempt of a possibility of the marriage ending.

Additionally, Economic Times of India Times explains that a prenup like agreement is only valid in the eyes of the Indian courts if both parties involved have signed the agreement voluntarily without threat, force, or undue influence, and if both parties agree to the terms. Aside from these restrictions, the prenup should also be fair to both parties: divisions of things such as financial assets, personal possession, and division of property must be certified by lawyers that each party should have. If a party wishes to do this without legal counsel, there are certain processes involved that will allow the enforcement of this prenup, such as another document stating that the person waives representation by a lawyer on the matter, and one is fully aware of what they are signing. Otherwise, the prenup won’t be enforced.

It’s important to understand that prenups can’t abridge or modify the statutory support obligations of a party towards a child. Courts can’t remove or limit a parent from being obliged to support their children.

Think Through Your Need for a Prenup

Marriage isn’t solely about the proverbial honeymoon phase, where a couple is so in love with each other that they tend to just “go with the flow.” Sometimes, it’s good to approach the subject of marriage thinking about potential scenarios that can affect your relationship with one another, and your status as individuals, and preparing for them. A premarital agreement or a prenup can be something to debate about, especially if you carefully think through the various advantages and disadvantages.

Regardless of your decision, and what your respective legal counsels may advise, in the end it’s better to have tackled key things and get a prenup than not to have discussed the topic at all.

After all, when you’re planning to enter a marriage it’s as good a time as any to assess not just your current financial situation, but your current situation as an individual. Do that now, before entering a new part of your life where you will make joint decisions with your partner. Protecting and ensuring you have personal assets or parts of your assets that won’t be touched by this union can be a guarantee that you have some degree of safety should the marriage not work out. In the end, it all boils down to what you’re willing to prepare for and what you plan on doing in these circumstances.

We were set up by a mutual friend and first met on a ‘blind’ date in Manchester – where we are both originally from in the UK.  It was love at first sight.

Nas’ proposal was truly magical, extra special and a massive surprise at the same time.  After first surprising me with a Versace dress he knew I liked, he whisked me away for a ‘staycation’ at the Waldorf Astoria Hotel, Ras Al Khaimah. Nas took my breath away when he proposed on the balcony underneath the stars.  I felt like a Princess.

Emirates Palace is the ultimate fairy tale wedding venue and it is a truly magical and iconic venue in Abu Dhabi.  We both always said how amazing and special it would be to get married there, but never in our wildest dreams did we envisage it actually happening.  We were blown away by everything it had to offer and could not resist making a fantasy become reality.

Our honeymoon…

We wanted to make our honeymoon extra special and go somewhere neither of us had been before. We chose South Africa and started off with 6 days Safari on two private game reserves – King’s Camp, Timbavati and Leopard Hills Camp, Sabi Sands.

We then ventured around the Wineland region of Cape Town – Stellenbosch and Franschhoek, visiting a number of wine estates which were all spectacular.  We followed up with two relaxing days on the coast at Birkenhead House in Hermanus, finishing our final stay in Camps Bay, Cape Town, before flying home to Abu Dhabi.

My favourite part of the wedding day…

The whole day was absolutely amazing; even more special than we had both imagined.  Having all our closest family and friends with us to celebrate our once in a lifetime, special day was truly incredible.  The best day of our lives so far.

My piece of advice for other brides…

I would definitely recommend investing in a videographer (in addition to a photographer), to capture the full wedding day; something to always treasure and relive the wonderful memories.

6 Things To Include In Your Guest Welcome Kit

Now that you’ve decided to have a destination wedding, you’ve got to spend equal thought in deciding how you’re going to make your guests feel welcome. It helps guests feel at home.

We suggest going with a dessert that won’t melt so unless your planning is that fool proof, we would suggest skipping those butter icing cupcakes. Crisps, chips and anything that involves loud munching is more than welcome. Of course, you do not have to opt for only fried snacks- you could always choose a heathy assortment of nuts, seeds or crackers as well. Our suggestion is to include a treat that is your personal favourite and which you know your guests would enjoy.

Here’s where the fun really lies. Your destination wedding will have a theme that plays out in the wedding décor and venue. The best way to let guests know what the theme of your wedding is, is by giving them a gift that matches the theme. For example, for a beach wedding, you could gift seashell candles, nautical bottle opener, a flip flop bottle opener or even a magnet featuring a beer mug. You can bet that your guests will use your thank you favours long after the wedding celebrations are over.

Rumour has it that Keith actually tried to propose to Rochelle not less than three times, which itself speaks volumes about his love for her.

Here’s what you need to know when it comes to rocking a drop dead gorgeous look this year:

Er, no, you don’t have to flaunt actual glass pieces on your lips but here’s what you should know- last year was all about getting dewy fresh skin and going natural. This year, that same dew like effect has shifted to lips and it can be achieved with tons of gloss for a ‘glass’ like or reflective effect.

So, the nude look was trending in such a big way this year- now you see makeup, now you don’t kind of a thing. And what’s surprising to note is that makeup artists are actually willing to let you wear your natural lip colour. Of course there’s lipstick added as well, but it isn’t dabbed all over and is applied in just a few spots. The effect is awesome.

9 Ways To Cut Down Wedding Food Costs

Somebody once remarked that Indian weddings seem to be more about the guest’s experience than about the bride and groom. While this statement may be exaggerated, it’s not entirely wrong either. After all, no Indian wants his guests to walk away unsatisfied with the manner in which the ceremony was conducted and most importantly, no guest should walk away dissatisfied at the spread of food laid out either.

So what have you? Indian weddings where not less than 100 dishes are served are the norm in many cultures across India, but the amount of food that goes wasted is just as huge too. So how can you curb your wedding food costs? We take a look at 9 ways to bring down your caterer bill:

1. Tone down the menu

First decide between serving a number of courses vs serving a variety of cuisines. There’s a difference between both and you’ll find that serving everything from appetizers to after dessert coffee is likely to be more expensive.

2.Eliminate the fancy stuff

Do away with the frills. And by that we mean, say no to that all tempting cheese platter, ice-cold seafood bar, exotic desserts and other fancy sounding bites. You’ll be doing your wallet a favour.

3. Re-consider your non-veg options

Assuming you plan to serve non-veg, considering poultry and other varieties of meat will prove to be a money saver vis-a-vis serving only seafood.

Here is the complete interview:

1) Tell us a bit about yourself. How did you start in the field of photography?

My Photography journey is nothing short of a roller coaster ( in a good way though). Going back in time, I was an Engineer, working for  Barclays but the rat race had made my life so mechanised that I kept wanting to do something else. I didn’t know what would give me the zeal for life again. In 2009, I went on a biking Expedition and scenic beauty made me pull out my small Samsung phone (Smartphone cameras were not as advanced then). Fellow riders liked my pictures and their encouragement made me post pictures online. In August 2012, I resigned and began working for myself, knowing I had a family of 6 to look after, something from within kept telling me I was on the right track and I was fortunate enough to catch the wave of 2012-13 That is how my journey began.

2) Do you shoot film or digital or both?

All of us at some point have used a film camera and the film cameras are truly a part of the golden era. Though I shoot digitally and clients want digital images rather than film,I secretly hope for a client who would want their output in film because film photography is the ultimate and I would love to shoot a wedding on film.

3) Describe your wedding photography style in 6 adjectives.

 WOW!!! This is a tough one. I am not sure I can find 6 adjectives Haha! Lets see,  my wedding photography style is non-intrusive, free flowing, eclectic,organised, contemporary and whimsical.

4) What do you love most about shooting Indian weddings?

Indian Weddings are the perfect example of organised chaos and I love it. It is a vast, open field of emotions, traditions, expressions, and colors which give a wedding photographer, like me, the opportunity to explore creatively. India is a massive country and from Kashmir to Kanyakumari we have an array of traditions, cultures and so much more that each wedding is unique. I always say this that even if at the same location, with the same guests and decor we have two couples getting married, the magic will be different in each couples images because weddings are all about connect. Friends and family, close and far, come miles to be together to celebrate a union and we get to be a part of their moments.

5) How do you put camera-shy couples at ease? 

Firstly guys, the camera is not scary even though it shoots Hahaha!! We have met many couples who are “Camera-Shy” and the main reason for that is the lack of familiarity of being in front of a camera in the presence of a team of photographers. Lets face it, all of us have faced the camera when we take a selfie, But shall I tell you a secret? A camera-shy couple usually ends up with some of the most stunning shots and that is because they have found solace within themselves and with each other in that moment. However, the process of getting to that “zone” shall always be a well guarded secret!

6) Who/what keeps you inspired?

My last shoot gives me a lot of inspiration because I know that the next one has to supersede the last one and my mind works towards creating something I have not done in the past.  Apart from that, GulzarSethi Photography Creative Director, Urvashi is a source of inspiration not only for me but the entire team. She is a butterfly who is always fluttering around. Her creative and crazy ideas are always driving us to deliver better.

7) Is there a dream location you’d like to shoot at?

Himalayas!!! Any day. I have been a biker and roamed the lonely roads with my bullet for company. Whist riding I have created scenes, sets, frames in my mind and I would love to have a fusion of the traditions of the hills meet the fast paced city couple. I am the sort of person who likes to get to the location and see how can I show it in the best/creative way possible way.

8) Tell us a bit about a challenging wedding you have covered. What made it so?

I am a wedding photographer guys, and challenge is literally my middle name. LOL! I don’t think I can say that one specific wedding was a challenge but rather that each wedding brings along challenges in some way or the other. A while ago, we shot a Royal wedding, the biggest challenge there being shooting so discreetly that we practically went unnoticed. See, here is an Indian wedding which did not have posed shots. At another instance, we shot a wedding in Pondicherry, where the bride who was a tom-boy by nature wanted to look elegant and graceful for her wedding images. Now, as a photographer there is just so much I can do, but how do I change someones personality? Ironically, even today her images are amongst the most popular shots that we have created. So wedding photography and its challenges cannot be summed up to just one wedding or one bride but the challenges are thrown at us in different ways and each rather different from the other.

9) Please give our readers a tip or two about choosing their wedding photographer?

 This is a frequently asked question and there are a number of factors a couple getting married must consider whilst choosing a wedding photographer. First and foremost, go through all their socials. This will give you an idea of their style of photography and also help you narrow down the ones whose style you like. Secondly, discuss in-depth about your events, how you see the final output and let them give their inputs as well. Remember, Connect is vital when choosing a Wedding Photographer because you are giving him/her the responsibility to freeze moments which you shall cherish a lifetime.

Wedding Functions

The wedding was a 3-day grand affair that started with a roka or engagement ceremony at Taj Land’s End. Guests were specially flown in jets personalised for the events and were put up at various grand properties in and around Jodhpur such as Umaid Palace, Ajit Bhawan, Hari Mahal by Taj, Raas Hotels, Radisson Green & Mariott. They were also shuttled around in vintage cars! Guests also got to enjoy a Masquerade ball, a poolside party, a Symphony of Souls Sangeet etc.

The creative team from Yolo Entertainment and Weddings handled everything from the roka to the reception. Here’s what Natasha Mehta, the groom’s sister, had to say about them: ” We couldn’t have asked for a better 3 day extravaganza for my brother ..I loved every minute of it! The best part is that they ensured that every event flowed seamlessly and as planned from the onset so we could relax and enjoy the celebrations!”

Talents such as Paris House Addict, Julia Bliss, Djembe drummers, musical rock- star Guru Randhawa, Dj Aman Nagpal & his band, Suryaveer Hooja, Silver Strings band and DJ AJ all lit up various functions with their outstanding performances. There were fireworks by Azan Morani from Morani Fireworks.

I got my make-up done by Mrs. Seema Saraf from Jaipur. She is a national award winner in bridal makeup and I think she did a great job! I asked her to focus mainly on eye-makeup which she did.

We chose our photographer because… 

School friends are the best to capture your favourite moments. So I chose Dream Wedding Photography Kolkata as our wedding photographer for the most special day of our lives. He executed the job perfectly being young, talented and creative whilst having his dad’s guidance as well.

We chose our venue because… 

We decided to have a palatial themed wedding and went back to our native village to celebrate this most special moment. My parents decided upon the Kuber Palace, Saradarshahar, Rajasthan as our wedding venue. This became even more special since Kapil’s grandfather had tied the knot there and ours would be a wedding nearly 52 years after his!

My piece of advice for other brides… 

Keep yourself calm and fit. Drink lots of water and do try to enjoy each and every ritual. Mark my words-you will cherish those moments and feelings all your life!

Shriya Saran Has Tied The Knot!

Shriya Saran is a very familiar name in the film industry down South and has her feet firmly planted across the Southern states. Rumours of a wedding just around the corner had been doing the rounds for some time now, but the gorgeous actress always said that she would let the world know when wedding bells were due to ring for her.

Well, it’s finally happened! The pretty actress and her Russian boyfriend Andrei Koscheev officially said ‘I Do’ in Udaipur on March 19 and got to enjoy a dream wedding. For starters, there was a traditional sangeet ceremony, engagement ceremony and a Holi party followed by an auspicious wedding ceremony that was attended by close family and friends.  Here’s what we know about all the celebrations that took place:

First there was a haldi ceremony held on March 18, followed by a noisy colour filled Holi party. We bet Shriya enjoyed letting her hair down with all her guests.

The party didn’t end there. In the evening there was an awesome sangeet held with plenty of singing and dancing. A formal engagement ceremony was held on Monday afternoon attended by just the family members.shriya saran

In the evening, the pre wedding ceremony commenced with the arrival of the baraat where beau Andrei looks dashing in a deep blue bandhgala. Shriya too looks lovely in a red lehenga complete with traditional Indian jewellery and the ceremony was performed in accordance with Hindu rites. This was of course followed by a wedding reception which saw only two Bollywood celebrities in attendance.

Love truly rules and what touched our hearts was Andrei reciting a Hindi poem to the love of his life. Here’s wishing the couple an amazing life ahead!

We met

Ours was an arranged match. We are both from Amritsar and must’ve met for the first time for no more than 10 minutes! But that was enough for Shubham and me to decide that we wanted to spend the rest of our lives together! I fell for his confidence and his good looks. We had a courtship of around 9 months before tying the knot in November 2018.

We had a a traditional big, fat wedding complete with Choorah ceremony, Shagun, Cocktail, party for the youngsters, followed by a dhol nigh, haldi, mehendi and the final ceremony.
